Bench trial set for Open Meetings case

Nov. 7, 2012 — A status hearing was held Friday morning in Johnson County in the case of Renee Stewart and Patrick Flannery vs. Carter County Fiscal Court.

A bench trial will be held in Carter Circuit Court on Thursday, Nov. 29 at 9 a.m.

Judge John David Preston, of Lawrence, Johnson, and Martin counties is the special judge presiding over the case. Since the case involves allegations of an open meeting violations by the Fiscal Court, Preston expedited the case.

Stewart, represented by attorney Sebastian Joy, and Flannery filed a suit in response to an opinion of the Attorney General’s office which stated that the AG could not determine if the May 29 meeting violated the Open Meetings Act.
