June 11, 2014 — A Carter County grand jury handed down indictments on three individuals May 23.
Jimmy Brewer, 50, of Flatwoods, was indicted on one count of third degree assault by assaulting a deputy jailer on April 10, a Class D felony.
Brewer also was indicted on one count of disarming a peace officer for depriving the same deputy jailer of a deadly weapon, also a Class D felony.
Stephen Howard, 36, and Shannon Howard, 31, both of Olive Hill, face three Class D felony indictments for theft of services over $500 and two counts of theft by deception.
According to the indictment, the Howards intentionally obtained electricity from AEP without the company's authorization. The theft by deception charges are linked to a worthless $500 debit card transaction that was not honored and a cold check written in the amount of $2,838.53.
The indictment of a person by a grand jury is an accusation only. That person is presumed innocent and is entitled to a fair trial at which the state must prove guilt beyond a reasonable doubt.
