Indictments released

April 22, 2009 A Carter County Grand Jury handed down the following indictments, which were recorded in the Carter County Circuit Clerk’s office on March 27, 2009, and are as follows:

• Roger A. Burnett, 41, of Carol Malone Blvd., Grayson, and Brian K. Burnett, 36, of Hancock Ave., Dayton, Ohio, were indicted on one count of trafficking (January 2009) in the scheduled I narcotic heroin, first degree, first offense, a Class C felony.

• Anthony S. Kershner, 30, of Walters Hill, Ashland, was indicted on one count of burglary in the second degree by burglarizing the home of Charles Stamper November 28, 2008, a Class C felony.

• Brian K. Burnett, 36, of Hancock Ave., Dayton, Ohio was indicted on one count of trafficking (January 2009) in the scheduled II narcotic powered cocaine and crack cocaine, first degree, first offense, a Class C felony. He was also indicted on one count of trafficking (January 2009) in the scheduled I narcotic heroin, first degree, first offense, a Class C felony.

• Isidro Bringas Vasquez, 26, of East Main Street, Grayson, was indicted on one count of trafficking (December 2008) in the scheduled II controlled substance oxycodone and being armed with a firearm, first degree, first offense, a Class B felony. He was also indicted on one count of trafficking in the scheduled IV non-narcotic controlled substance alprazolam while armed with a firearm, a Class D felony. A third count charged him with carrying a concealed weapon by carrying a 22 cal. pistol, a Class A misd.

• Thomas L. Peck, 29, of Providence Pike, Brookville, Ohio was indicted one count of promoting contraband in the first degree by introducing marijuana into the Carter County Detention Center on January 31, 2009. He was also indicted on one count of trafficking in the scheduled II narcotic controlled substance crack cocaine, first degree, first offense, a Class C felony. A third count charges him with trafficking in the scheduled I narcotic controlled substance heroin, first degree, first offense, a Class C felony.

• Roger A. Burnett, 41, of Carol Malone Blvd., Grayson, was indicted on one count of trafficking (November 2008) in the scheduled I narcotic controlled substance heroin, first degree, first offense, a Class C felony.

• Roger A. Burnett, 41, of Carol Malone Blvd., Grayson, and Brian K. Burnett, 36, of Hancock Ave., Dayton, Ohio, were indicted on one count of trafficking (January 2009) in the scheduled I narcotic controlled substance heroin, first degree, first offense, a Class C felony.

The following indictments were recently released, however recorded on December 19, 2008.

• Kristopher D. Felty, 25, of East Sunset Hill, Grayson, was indicted on one count of trafficking (August 2008) in the scheduled II controlled substance oxycodone, first degree, first offense - a class C felony.

• Gregory Waggoner, 29, of Damron Mayo, Grayson was indicted on one count of trafficking (August 2008) in the scheduled II controlled substance oxycodone, first degree, first offense, a Class C felony.

• John W. Messer, 30, of Wine Wood Land, Hitchins, was indicted on one count of trafficking (November 2008) in the scheduled II controlled substance heroin, first degree, first offense, a Class C felony.

• Charles E. Smith, 26, of Paradise Hill, Grayson, was indicted on two counts of trafficking (June 2008 and September 2008) in the scheduled II controlled substance oxycodone, first degree, first offense, Class C felonies.

• Chris Sparks, 39, of Fairview Hill, Hitchins, was indicted on one count of trafficking (August 2008) in the scheduled II controlled substance oxycodone, first degree, first offense, a Class C felony.

• Brogan Dudding, 20, of Black Hawk Road, Grayson, was indicted on one count of trafficking (August 2008) in the scheduled II controlled substance oxycodone, first degree, first offense, a Class C felony.

• Grace Marshall, aka Grace Spillman, 26, of Hord Street, Grayson, was indicted on one count of trafficking (April 2008) in the scheduled II controlled substance oxycodone, first degree, first offense, a Class C felony.

• Joey McCleese, 35, of New Hill Road, Olive Hill, was indicted on one count of trafficking (October 2007) in the scheduled II controlled substance oxycodone, first degree, first offense, a Class C felony. He was also indicted on one count of trafficking (October 2007) in the scheduled II controlled substance cocaine, first degree, first offense, a Class C felony.

An indictment is a formal accusation and does not prove guilt.
