Seven indicted

Dec. 30, 2009 — Seven people were indicted Dec. 18 by a Carter County grand jury on charges including burglary, receiving stolen property and first-degree wanton endangerment against three police officers.

Toby W. Kronmueller, 39, of Morehead, faces five misdemeanor charges and five felony charges when he allegedly Oct. 24 threatened to kill Carter County Sheriff Deputy Paul Meeks while pointing a pistol at Meeks and two other deputies.

According to the indictment, Kronmueller was in a routine traffic check in Carter County and was allegedly discovered to be under the influence of alcohol or drugs (Class B Misdemeanor).

While investigating the situtation, officers discovered Kronmueller was operating the vehicle on a DUI suspended license being his second offense (Class A Misdemeanor). The defendant then allegedly attempted to flee police on foot and disobeyed an order to stop (Class A Misdemeanor). Kronmueller then allegedly pulled out a pistol and pointed it at Officers Steve Porter, Phillip Cox and Meeks (Three Class D Felony charges).

The defendant then allegedly with force resisted arrest (Class A Misdemeanor) and then allegedly threatened to kill Meeks (Class A Misdemeanor).

After resisting arrest and allegedly committing the offense of third degree terroristic threatening, Kronmueller allegedly assaulted Meeks, causing physical injury to the officer (Class D Felony). After being taken into custody police discovered Kronmueller had a criminal history and was able to also charge him with convicted felon in possession of a firearm.

Kronmueller is being held in the Carter County Detention Center on a $25,000 full-cash bond.

Other indictments include:

• Michael Scott Ludwig, 25, 200 block of Bourbon Hollow in Grayson, one charge of third-degree burglary when he allegedly Sept. 22 burglarized a storage unit belonging to Michael Ison (Class D Felony).

• Suzanna Hoskins, 25, 30 block of Hamm Lane in Morehead, one charged of second-degree burglary when she allegedly Sept. 25 burglarized the residence of Virgil Darvin (Class C Felony).

• Jason Smith, 31, 2000 block of Spring Valley Road in Huntington and Michelle B. Legrand, 1000 block of Buffalo Creek Road in Huntington, one charge each of receiving stolen property when the two allegedly Sept. 24 received a HDTV and a DVD while knowing the items had been stolen from K-Mart (Class D Felony).

• Garrett E. Ratcliff, 27, 20 block of Geiger Lane in Rush, one charge of first-degree fleeing or evading police when he allegedly Oct. 19 disobeyed directions to stop his motor vehicle, and while alluding the police officer he created substantial risk or serious physical injury or death to Shelly Adkins (Class D Felony); one charge of second-degree fleeing or evading police when he Oct. 19, while on foot, disobeyed a direction given by a police officer (Class A Misdemeanor) and one charge of operating a vehicle on a suspended or revoked license (Class B Misdemeanor).

• Joseph Messer, 45, 400 block of Smith Branch in Grayson, one charge of convicted felon in possession of a firearm when he allegedly Oct. 5 was discovered to have a .22 rifle and a shotgun (Class D Felony); one charge of cultivating marijuana, less than five plants; one charge of possession of marijuana and one charge of possession of drug paraphernalia when he was allegedly found with a pipe, rolling papers and a roach clip all used in the illegal use of marijuana.

A grand jury indictment is a formal accusation of a crime and does not establish guilt.
