December 12, 2007 The week of Monday, Dec. 3, 2007 was another busy week in the Carter County Court System.

On Monday, December 3, 2007, the District Court conducted arraignments, preliminary hearings, other evidentiary hearings, and pre-trial conferences:

1. 22 (twenty-two) individuals came before the Court charged with DUI.

a) 5 (five) plead guilty all of whom were sentenced to a suspension of their drivers license, fines and cost of at least $667.00 (six hundred sixty-seven dollars), and two of whom were convicted of an aggravating circumstance and received a 4 (four) day jail sentence as well.

b) 1 (one) was set for preliminary hearing with accompanying felony charges, for possible transfer to the Grand Jury.

c) 1 (one) was set for pre-trial conferences while awaiting lab results from the state crime labs which would provide the results of a urine sample obtained by police officers.

d) 11 (eleven) were re-scheduled for another hearing or jury trial.

e) 1 (one) failed to appear and bench warrant were issued for their arrest.

f) 1 (one) was set for suppression hearing for the Court to rule on the defendant‚s objections to the Commonwealth‚s evidence.

g) 2 (two) were dismissed due to a lack of evidence caused by insufficient lab results.

2. 1 (one) individual appeared before the court and was charged with illegal possession of prescription medications, which charges were dismissed when the Defendant produced a valid prescription for the medication

3. 1 (one) individual appeared before the court charged with possession of marijuana, who plead guilty and received a total fine and court cost of $348.00 (three hundred forty-eight dollars), and was sentenced to ten days in jail, probated for 2 (two) years, upon the condition that they commit no further violations of law.

On Friday, December 7, 2007, 1 (one) defendant was tried before a jury and was convicted of DUI and Operating on a Suspended Operators License for which he received a penalty of 30 (thirty) days in the County Jail and fines and costs of at least $1,467.00 (one thousand four hundred sixty-seven dollars).

2 (two) other individuals also came before the court for DUI on December 7, 2007, who upon their pleas of guilty received 7 (seven) days in jail, license suspension of 12 (twelve) months and total fines and court cost of at least $817.00 (eight hundred seventeen dollars).
