Jurors were unable to reach a verdict Tuesday night after more than eight hours of deliberation in the trial of a Grayson man accused of manslaughter.
Clifford "Boomer" Cathey was facing 10 years to life in prison for the New Year's Day 2012 beating death of Heath Toney.
Judge Rebecca Phillips declared a mistrial shortly before midnight when the jury assured her they were unable to reach a unanimous decision.
A status hearing has been set for Jan. 6.
Generally, in the case of a mistrial due to a deadlocked jury, a defendant will stand trial again.
